Skilled Workers

Green Card Eligibility
Individuals who qualify for an EB3 visa will also receive a U.S. Green Card.

Additionally, the applicant’s legal spouse and unmarried children under the age of 21 can apply as dependents for residency in the United States.

Processing Time for the EB3 Visa
The process for this visa typically takes about six months. However, if the U.S. government requires PERM labor certification, the process may take longer, potentially up to two years.

Steps to Apply for the EB3 Visa

Employer Process
- Obtaining Labor Certification: The U.S. employer must prove that no qualified American workers are available for the job and obtain certification from the Department of Labor (DOL).
- Submitting the Petition: The employer must file the necessary petition with the U.S. Citizenship and Immigration Services (USCIS), demonstrating financial ability to pay the employee's wages.
Employee Process
- Complete Form DS-261 (Choice of Address and Agent): This is an online form filled out by the worker, and a confirmation page is sent to the National Visa Center (NVC).
- Medical Examination and Vaccination: The worker must undergo a full medical check-up and ensure all required vaccinations are completed. Missing vaccinations must be administered.

Post-Visa Approval
Once your visa is approved, you will receive a sealed package that must remain unopened. When you arrive in the U.S., you must hand this package over to an immigration officer at a port of entry.
